Maaomanik pakkus v\u00e4lja ebatavalise lahenduse, kus olemasoleva tee \u00fchiskasutuse asemel rajab ta naabri kinnistule uue juurdep\u00e4\u00e4sutee, kandes k\u00f5ik kulud. Naaber oma maale uut teed ei soovinud. Kohtud maaomaniku ettepanekuga ei n\u00f5ustunud, mis kinnistab kohtupraktikat, kus olemasoleva tee korral avalikule teele juurdep\u00e4\u00e4su vajav naaber selle suure t\u00f5en\u00e4osusega saab ja seda l\u00e4bi juba eksisteeriva tee.
