Nimelt esitas ostuhuviline hagi broneerimislepingu t\u00fchisuse tuvastamiseks p\u00f5hjendusega, et mere\u00e4\u00e4rsel kinnistul ilmnesid ehitamist piiravad piirangud ja kitsendused ning hageja on sattunud seel\u00e4bi eksimusse. Maakohus n\u00f5ustus TRINITI argumentidega, et maakler ei ole ostuhuvilist eksimusse viinud ja avalikult n\u00e4htuvad piirangud ei saa olla olulise eksimuse aluseks Ts\u00dcS \u00a7 92 lg 2 t\u00e4henduses ning seega ei ole broneerimislepingut kehtivalt t\u00fchistatud.
