E<\/span><span data-contrast=\"auto\">hitusloa eeln\u00f5u\u00a0<\/span><span data-contrast=\"auto\">koosk\u00f5lastamata j\u00e4tmist tuleb p\u00f5hjendada<\/span><span data-contrast=\"auto\">.\u00a0<\/span><span data-contrast=\"auto\">Kohalik omavalitsus ei saa seejuures koosk\u00f5lastava asutuse keeldumist\u00a0<\/span><span data-contrast=\"auto\">ise<\/span><span data-contrast=\"auto\">\u00a0\u00fcmber\u00a0<\/span><span data-contrast=\"auto\">hinnata<\/span><span data-contrast=\"auto\">\u00a0ja ehitusluba seda ignoreerides ikkagi v\u00e4lja anda<\/span><span data-contrast=\"auto\">.<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">Kohaliku omavalitsuse otsustusp\u00e4devus piirdub vaid kontrollimisega, kas koosk\u00f5lastusest keeldumine pole olnud ilmselgelt meelevaldne.<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-contrast=\"auto\">Samas\u00a0<\/span><span data-contrast=\"auto\">peab omavalitsus huvitatud isiku ja koosk\u00f5lastava asutusega suheldes v\u00e4lja selgitama, kas on v\u00f5imalik\u00a0<\/span><span data-contrast=\"auto\">projekti muuta selliselt, et ehitamine oleks ikkagi lubatav.\u00a0<\/span><span data-contrast=\"auto\">(<\/span><span data-contrast=\"auto\">RKHKo nr 3-17-2766, p\u00a0<\/span><span data-contrast=\"auto\">27-28). Samas ei t\u00e4henda see, et kasutusloa andmisel ehitusluba \u00e4ra unustataks. Vastupidi \u2013 kasutusloa andmisel v\u00f5ib selguda, et ehitusluba anti \u00f5igusvastaselt<\/span><span data-contrast=\"auto\">. N<\/span><span data-contrast=\"auto\">\u00e4iteks j\u00e4eti keegi menetlusse kaasamata v\u00f5i on ehitusluba vastuolus planeeringug<\/span><span data-contrast=\"auto\">a.
