See t\u00e4hendab, et ka kinnisvarab\u00fcrood on seaduse m\u00f5ttes kohustatud isikud ning peavad t\u00e4itma k\u00f5iki neile pandud kohustusi.<!--more-->\n\n<a href=\"https:\/\/triniti.ee\/wp-content\/uploads\/sites\/2\/2021\/02\/euro-163475_960_720.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-12242\" src=\"https:\/\/triniti.ee\/wp-content\/uploads\/sites\/2\/2021\/02\/euro-163475_960_720.jpg\" alt=\" width=\"948\" height=\"720\"><\/a>\n\nM\u00f6\u00f6dunud aasta jooksul on ka ajakirjanduses olnud juttu sellest (vt nt \u00c4rip\u00e4eva <span style=\"color: #008cc8;\"><a style=\"color: #008cc8;\" href=\"https:\/\/www.aripaev.ee\/uudised\/2019\/10\/14\/rahapesu-andmeburoo-vottis-maaklerid-pihtide-vahele\" target=\"_blank\" rel=\"noopener\">selleteemalist artiklit<\/a><\/span>), et rahapesu andmeb\u00fcroo teostab kontrolli kinnisvarab\u00fcroode \u00fcle. Meile teadaolevalt on Rahapesu andmeb\u00fcroo alustanud ja l\u00e4bi viinud ka mitmeid v\u00e4\u00e4rteomenetlusi kinnisvarab\u00fcroode suhtes. T\u00f5si, 2020.&nbsp;aasta suvel Riigikogu m\u00f5nev\u00f5rra leevendas RahaPTS regulatsiooni kinnisvarab\u00fcroode suhtes ning seaduse n\u00f5udeid peavad j\u00e4rgima vaid need kinnisvarab\u00fcrood, kes vahendavad kinnisasja ostu v\u00f5i m\u00fc\u00fcki (m\u00fc\u00fcgihind ei ole seejuures m\u00e4\u00e4rav) ning kes vahendavad kinnisvara \u00fc\u00fcri- v\u00f5i renditehinguid, mille \u00fche kuu \u00fc\u00fcri- v\u00f5i renditasu on v\u00e4hemalt 10&nbsp;000 eurot.\n<h5><strong>Kinnisvaratehingutega seonduv<\/strong><\/h5>\nTeatavasti on Eestis seaduse kohaselt v\u00f5imalik kinnisvara m\u00fc\u00fcgitehingut teha \u00fcksnes notariaalselt t\u00f5estatud vormis. See t\u00e4hendab, et mistahes kinnisvara m\u00fc\u00fck saab toimuda \u00fcksnes siis, kui leping s\u00f5lmitakse notari juures. Seejuures kohaldab notar k\u00f5igi tehingus osalejate suhtes omakorda hoolsusmeetmeid, st uurib v\u00e4lja k\u00f5ik, mis seaduse kohaselt n\u00f5utud \u2013 sh tegeliku(d) kasusaaja(d), tehingu tegemiseks kasutatava raha ning kliendi vara p\u00e4ritolu, jne.\n\nSeaduse kohaselt aga peab ka kinnisvarab\u00fcroo, kes \u00fcldjuhul osutab maaklerteenust \u00fcksnes kinnisvara m\u00fc\u00fcjale, t\u00e4itma siiski k\u00f5iki seaduse n\u00f5udeid ning kohaldama n\u00f5utud hoolsusmeetmeid nii oma kliendi (m\u00fc\u00fcja) kui ka ostja suhtes. L\u00fchidalt kokkuv\u00f5ttes t\u00e4hendab see k\u00f5ik sisuliselt seda, et kinnisvarab\u00fcroo peab tuvastama nii oma kliendi (m\u00fc\u00fcja) kui ka ostja isiku, nende tegeliku(d) kasusaaja(d), kas keegi osalistest on riikliku taustaga isik, nii m\u00fc\u00fcja kui ostja raha ja vara p\u00e4ritolu ning saama aru tehingu sisust. Seejuures tekitab segadust, kas maakler peab hoolsusmeetmeid kohaldama iga v\u00f5imaliku ostjakandidaadi suhtes v\u00f5i ainult selle isiku suhtes, kellega m\u00fc\u00fcja l\u00f5puks notari juurde tehingut tegema l\u00e4heb.\n\nPuudub selge arusaam, miks peavad kinnisvarab\u00fcrood uurima kinnisvara osta sooviva isiku tausta. Enamgi veel \u2013 see v\u00f5ib nende jaoks osutuda sisuliselt v\u00f5imatuks, kuna \u00fcldjuhul ei ole osta sooviv isik kinnisvarab\u00fcroo klient. Kliendiks on valdaval osal juhtudest ikkagi m\u00fc\u00fcja. V\u00f5imaliku ostjaga aga puudub kinnisvarab\u00fcrool kliendisuhe, mis t\u00e4hendab, et ostja ei pruugi \u00fcldse n\u00f5ustuda oma k\u00f5igi andmete avaldamisega kinnisvarab\u00fcroole.
