See t\u00e4hendab, et vastavalt neis samades artiklites toodud alustel v\u00f5ib neid \u00f5igusi seaduse alusel piirata. N\u00e4iteks liikumisvabaduse puhul on lubatud seaduslikud eesm\u00e4rgid: <\/span><span data-contrast=\"auto\">kui see on vajalik demokraatlikus \u00fchiskonnas riigi julgeoleku v\u00f5i \u00fchiskondliku turvalisuse huvides, <\/span><i><span data-contrast=\"auto\">ordre<\/span><\/i> <i><span data-contrast=\"auto\">public<\/span><\/i><span data-contrast=\"auto\"> (avaliku korra) s\u00e4ilitamiseks, kuritegevuse \u00e4rahoidmiseks, tervise v\u00f5i k\u00f5lbluse v\u00f5i kaasinimeste \u00f5iguste ja vabaduste kaitseks<\/span><span data-contrast=\"auto\">. <\/span><span data-contrast=\"auto\">Seega see, m<\/span><span data-contrast=\"auto\">iks on vajalik nende kehtivuse peatamine, on juriidilise anal\u00fc\u00fcsi alusel arusaamatu.\u00a0<\/span><span data-wac-het=\"1\" data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span>\n\n<span data-contrast=\"none\">Enamgi veel, k<\/span><span data-contrast=\"none\">ohtuliku kontrolli raames on <\/span><span data-contrast=\"none\">varasemate artikkel 15 juhtumite puhul EIK <\/span><span data-contrast=\"none\">ikka <\/span><span data-contrast=\"none\">esmalt k\u00fcsinud<\/span><span data-contrast=\"none\">, kas <\/span><span data-contrast=\"none\">tavap\u00e4rased seaduse<\/span><span data-contrast=\"none\">d<\/span><span data-contrast=\"none\"> oleks olnud piisavad tulemaks toime ohuga, mida eriolukord p\u00f5hjustab<\/span> <span data-contrast=\"none\">(<\/span><i><span data-contrast=\"none\">Lawless<\/span><\/i><i><span data-contrast=\"none\"> v. <\/span><\/i><i><span data-contrast=\"none\">Ireland<\/span><\/i><i><span data-contrast=\"none\"> (no. 3)<\/span><\/i><span data-contrast=\"none\">, \u00a7 36)<\/span><span data-contrast=\"none\">. <\/span><span data-contrast=\"none\">V\u00f5tame n\u00e4itena liikumisvabaduse Saaremaal. N\u00f5ustuda tuleb, et EIK on ammu leidnud, et liikumisvabaduse piirangu ja vabaduse v\u00f5tmise eristamine <\/span><span data-contrast=\"none\">on peen kunst ja <\/span><span data-contrast=\"none\">oleneb piirangust t\u00f5sidusest: <\/span><span style=\"color: #008cc8;\"><a style=\"color: #008cc8;\" href=\"http:\/\/hudoc.echr.coe.int\/eng?i=001-57498\">saarele pagendamine<\/a><\/span><span data-contrast=\"none\"> t\u00e4henda<\/span><span data-contrast=\"none\">ks<\/span><span data-contrast=\"none\"> vabaduse v\u00f5tmist, samas kui reisikeel<\/span><span data-contrast=\"none\">d, mis <\/span><span style=\"color: #008cc8;\"><a style=\"color: #008cc8;\" href=\"http:\/\/hudoc.echr.coe.int\/eng?i=001-113118\"><i>de facto<\/i> v\u00e4listab saarelt lahkumise<\/a><\/span> <span data-contrast=\"none\">on liikumisvabaduse riive<\/span><span data-contrast=\"none\">.<\/span><span data-contrast=\"none\"> Kuigi tundub nagu juriidiline n\u00fcanss, siis tegelikkuses on vahe suur \u2013 sest protokollis nimetatud liikumisvabadust v\u00f5ib piirata oluliselt arvukamatel eesm\u00e4rkidel (s.h. avalik kord, \u00fchiskondlik turvalisus, rahvatervis), kui v\u00f5tta isiku vabadust.<\/span><span data-wac-het=\"1\" data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span>\n\n<span data-contrast=\"none\">Praegusel hetkel ei n\u00e4htu \u00fchegi praktikas ellu<\/span> <span data-contrast=\"none\">viidud meetme puhul, et tavalistest kehtivatest seadustest ei oleks piisanud nende elluviimiseks<\/span><span data-contrast=\"none\"> \u2013 sest milline neist ei omaks eesm\u00e4rki kaitsta rahvatervist v\u00f5i muud v\u00e4\u00e4rtust, mis konkreetses artiklis etten\u00e4htud? <\/span><span data-contrast=\"none\">Kas meetmete eesm\u00e4rk saakski olla muud?\u00a0<\/span><span data-wac-het=\"1\" data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span>\n\n<span data-contrast=\"auto\">Enamgi veel, meedia vahendusel on meie justiitsminister ja teised ametnikud selgitanud, et eelk\u00f5ige oli peatamine vajalik, sest meetmed v\u00f5ivad vajalikuks osutuda. <\/span><span data-contrast=\"auto\">Ehk siis v\u00f5ib v\u00e4lja lugeda, et sellised meetmed on alles plaanimisel, mis meie vabadusi piirama hakkavad. See aga tekitab ikkagi k\u00fcsimusi, sest <\/span><span data-contrast=\"auto\">ennetav teavitus on ebavajalik ega aita kaasa usalduse, \u00f5igusriikluse ja demokraatlikkuse p\u00f5him\u00f5ttetele. Nimelt on EIK leidnud asjas <\/span><span style=\"color: #008cc8;\"><a style=\"color: #008cc8;\" href=\"https:\/\/hudoc.echr.coe.int\/eng?i=001-73858\">Kreeka v \u00dchendkuningriigid<\/a><\/span><span data-contrast=\"auto\">, et teavitust peatamise kohta ei ole vaja teha enne meetmete kasutusele v\u00f5ttu.\u00a0<\/span><span data-wac-het=\"1\" data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span>\n\n<span data-contrast=\"auto\">Relevantne ei tundu ka <\/span><span style=\"color: #008cc8;\"><a style=\"color: #008cc8;\" href=\"https:\/\/arvamus.postimees.ee\/6935909\/valisministeerium-inimoiguste-piiramisest-teavitamine-oli-meie-kohus\">kajanud seisukoht<\/a><\/span><span data-contrast=\"auto\">, et peatamine teenib riigi huve kui hiljem tekivad erinevate piirangute osas vaidlused. EIK on ka varasematel juhtudel, kus artiklit 15 on rakendatud, anal\u00fc\u00fcsinud meetmeid <\/span><span data-contrast=\"auto\">tervikliku<\/span><span data-contrast=\"auto\">lt <\/span><span data-contrast=\"auto\">k\u00f5igi konventsiooni v\u00e4\u00e4rtuste vastu, mist\u00f5ttu peatamise toiming ei muuda vaidluse kulgu ega suure t\u00f5en\u00e4osusega ka tulemust.\u00a0<\/span><span data-wac-het=\"1\" data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span>\n<h5><b><span data-contrast=\"auto\">Teavituse tagasiv\u00f5tmise \u00fcleskutse<\/span><\/b><span data-wac-het=\"1\" data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/h5>\n<span data-contrast=\"auto\">E<\/span><span data-contrast=\"auto\">IK on korduvalt leidnud, et isegi <\/span><span data-contrast=\"auto\">h\u00e4daolukorras peavad riigid meeles pidama, et k\u00f5igi v\u00f5etud meetmete eesm\u00e4rk peaks olema kaitsta demokraatlikku korda <\/span><span data-contrast=\"auto\">sellele <\/span><span data-contrast=\"auto\">tekitatavate ohtude eest ning tuleks teha k\u00f5ik endast olenev demokraatliku \u00fchiskonna v\u00e4\u00e4rtuste, n\u00e4iteks pluralismi, sallivuse <\/span><span data-contrast=\"auto\">tagamiseks <\/span><span data-contrast=\"auto\">(<\/span><i><span data-contrast=\"none\">Mehmet<\/span><\/i> <i><span data-contrast=\"none\">Hasan<\/span><\/i> <i><span data-contrast=\"none\">Altan<\/span><\/i><i><span data-contrast=\"none\"> v. <\/span><\/i><i><span data-contrast=\"none\">Turkey<\/span><\/i><span data-contrast=\"auto\">, \u00a7 210<\/span><span data-contrast=\"auto\">). <\/span><span data-contrast=\"auto\">Kuna antud juhul ei n\u00e4htu sellise osalise peatamise eesm\u00e4rk, vajadus ega ole seda kuidagi teostatud austades demokraatlikule protsessile omast debativajadust, siis ei saa <\/span><span data-contrast=\"auto\">teha <\/span><span data-contrast=\"auto\">muu<\/span><span data-contrast=\"auto\">d<\/span><span data-contrast=\"auto\">, kui \u00fchineda <\/span><span data-contrast=\"auto\">paljude teiste, s.h.
