Kinnisasja koormamisel juurdep\u00e4\u00e4suga kasutuseelise kaotamise h\u00fcvitamise eesm\u00e4rk on tagada kinnisasja omaniku samasugune seisund, milles ta oleks olnud, kui ta oleks saanud juurdep\u00e4\u00e4sualust maat\u00fckki juurdep\u00e4\u00e4suta ise kasutada, sh kasutada tee alla j\u00e4\u00e4vat maad m\u00f5nel muul otstarbel.\n\nKuiv\u00f5rd vaidluse all oli k\u00fcsimus sellest, kas h\u00fcvitist saab ka parkimise eest, selgitas ringkonnakohus, et \u00fche korteri kohta on \u00fcks parkimiskoht ning v\u00f5imalike l\u00e4hedastega, kes ka on ehk enne parkinud juurdep\u00e4\u00e4su alla j\u00e4\u00e4val alal, ei saa \u00f5igustada ega suurendada parkimiskohti.\n\nKohus selgitas ka seda, et juhul kui vaidlusalune juurdep\u00e4\u00e4s ja kaotatud parkimiskoht ei asu tasulise parkimise alal, siis ei saa h\u00fcvitise m\u00e4\u00e4ramisel l\u00e4htuda tasuliste parklate v\u00f5i ka linna hinnakirjadest parkimiseks avalikus ruumis. Kohus v\u00f5ttis aluseks samav\u00e4\u00e4rse maa ruutmeetrite \u00fc\u00fcrihinnad, mis on arusaadavalt oluliselt madalamad kui parkimishinnad.\n\nJuurdep\u00e4\u00e4sutasu kindlaksm\u00e4\u00e4ramisel arvestas kohus ka juurdep\u00e4\u00e4sutee kasutamise proportsiooni teeniva ja valitseva kinnistu vahel &#8211; antud vaidluses oli nn tagumisel vajal vaja juurdep\u00e4\u00e4su k\u00f5ikidele korteritele ka majja p\u00e4\u00e4semiseks, samas eesmine maja kasutaks juurdep\u00e4\u00e4su vaid hoovi ja m\u00e4nguv\u00e4ljaku ning \u00fche parimiskoha kasutamiseks. Seega leidis kohus, et tagumine maja kasutab juurdep\u00e4\u00e4su 100% ja esimene maja 25% ulatuses ning arvutas vastava proportsiooniga ka juurdep\u00e4\u00e4sutasu.\n\nRingkonnakohtu m\u00e4\u00e4rus ei ole veel j\u00f5ustunud.
