Lisaks osa m\u00fc\u00fcgilepingutele puudutab muudatus ka tegelikult osanike lepinguid ja optsioonilepinguid, mis pidid samuti olema notariaalses vormis, kui need sisaldasid ka kokkuleppeid osa m\u00fc\u00fcmise v\u00f5i m\u00fc\u00fcmisest hoidumise kohta. Varem lubas seadus teha osadega tehinguid lihtkirjalikult (st ilma notari juurde minemata) ainult siis, kui osad olid kantud EVK-sse. Muudatused j\u00f5ustuvad 1. augustil ehk juba sellel suvel. Et muudatusest kasu l\u00f5igata, peab silmas pidama aga neid aspekte.<!--more-->\r\n<ol>\r\n \t<li><strong>Osakapital peab olema v\u00e4hemalt 10\u00a0000 eurot ja sisse makstud<\/strong><\/li>\r\n<\/ol>\r\nSeadusemuudatuse kohaselt on v\u00f5imalik notariaalsest vormin\u00f5udest lahti \u00f6elda vaid juhul, kui osa\u00fchingu osakapital on v\u00e4hemalt 10\u00a0000 eurot. Lisaks peab kapital olema t\u00e4ielikult sisse makstud. Kui need tingimused t\u00e4idetud ei ole, n\u00e4iteks kui osa\u00fching on asutatud sissemakseta v\u00f5i ei k\u00fc\u00fcndi osakapital 10\u00a0000 euroni, kehtib siiski varasem notariaalne vormin\u00f5ue.\r\n<ol start=\"2\">\r\n \t<li><strong>Vormin\u00f5udest loobumine peab toimuma p\u00f5hikirjas<\/strong><\/li>\r\n<\/ol>\r\nEt v\u00f5\u00f5randamistehingu notariaalsest vormist loobuda, tuleb loobumine ette n\u00e4ha p\u00f5hikirjaga. Juba olemasolevate osa\u00fchingute puhul tuleb selleks muuta p\u00f5hikirja. Seadusemuudatus n\u00e4eb siiski ette, et p\u00f5hikirja kinnitamine v\u00f5i muutmine vormin\u00f5udest loobumiseks n\u00f5uab k\u00f5ikide osanike n\u00f5usolekut. Seega on v\u00f5imalik vormin\u00f5udest loobuda vaid \u00fcheh\u00e4\u00e4lselt.\r\n<ol start=\"3\">\r\n \t<li><strong>T\u00e4ielikku vormivabadust ei ole<\/strong><\/li>\r\n<\/ol>\r\nOsa\u00fchingud v\u00f5ivad eeltoodud tingimustel loobuda notariaalsest vormin\u00f5udest, kuid see ei t\u00e4henda, et edaspidi \u00fcldse mingit vormin\u00f5uet ei kehtiks. Seadusemuudatuse j\u00e4rgselt tuleb notariaalsest vormist loobunud \u00fchingute korral osa v\u00f5\u00f5randamistehingud s\u00f5lmida siiski v\u00e4hemalt kirjalikku taasesitamist v\u00f5imaldavas vormis. Kirjalikku taasesitamist v\u00f5imaldav vorm h\u00f5lmab reeglina e-kirju, SMS-s\u00f5numeid jms.\r\n\r\nSeega on eelnevalt toodud tingimustel v\u00f5imalik osa\u00fchingutel osa v\u00f5\u00f5randamisel v\u00f5imalik notariaalsest vormin\u00f5udest loobuda. Muudatus puudutab lisaks osa v\u00f5\u00f5randamisele ka osanike lepingute ja optsioonilepingute s\u00f5lmimist.
