Looduskaitseseadus kehtestab keelule konkreetsed erandid. Hiljutisest Riigikohtu lahendist aga selgub, et inimesed kipuvad erandeid kohtute arvates ehk liiga laialt t\u00f5lgendama.<!--more-->\n\n<a href=\"https:\/\/triniti.ee\/wp-content\/uploads\/sites\/2\/2020\/01\/lake-2451256_1280.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-10703\" src=\"https:\/\/triniti.ee\/wp-content\/uploads\/sites\/2\/2020\/01\/lake-2451256_1280-1024x574.jpg\" alt=\" width=\"1024\" height=\"574\" \/><\/a>\n\nNimelt karistati \u00fcht f\u00fc\u00fcsilist isikut v\u00e4\u00e4rteomenetluse korras rahatrahviga selle eest, et ta paigaldas ehituskeeluv\u00f6\u00f6ndisse kivisillutise, t\u00fcnnisauna ja k\u00fcmblust\u00fcnni. Maakohus tema kaebust ei rahuldanud. Riigikohus rahuldas kassatsioonkaebuse l\u00f5petas v\u00e4\u00e4rteomenetluse, kuna vahepeal muutunud seaduse t\u00f5ttu ehituskeeluv\u00f6\u00f6ndit selles asukohas enam ei eksisteerinud. Hoopis huvitavam on aga, et Riigikohus pidas muus osas maakohtu otsuses esitatud j\u00e4reldusi \u201en\u00f5ustumisv\u00e4\u00e4rseks\u201c. Mida siis maakohus Riigikohtu arvates \u00f5igesti leidis?\n\nEsiteks oli asjas vaidluse all, kas t\u00fcnnisaun ja k\u00fcmblust\u00fcnn on \u00fcldse ehitised. Ehitusseadustik alustab ehitise definitsiooni nii: \u201eEhitis on inimtegevuse tulemusel loodud ja aluspinnasega \u00fchendatud v\u00f5i sellele toetuv asi \/&#8212;\/\u201c. Maakohus leidis, et kuna ehitised v\u00f5ivad olla teisaldatavad ega pea olema aluspinnaga kohtkindlalt \u00fchendatud, on ka t\u00fcnnisaun ja k\u00fcmblust\u00fcnn ehitised. Retooriliselt v\u00f5iks k\u00fcsida, kas j\u00e4reldust muutnuks see, kui leidnuks t\u00f5endamist, et t\u00fcnni saanuks h\u00f5lpsasti n\u00f6 keskmise inimese j\u00f5ul \u00fchest asukohast teise veeretada?\n\nTeiseks oli vaidlus selles, kas kivisillutist v\u00f5iks k\u00e4sitleda juba varem rajatud puidust paadisilla laiendusena. Nimelt, lautrit ja paadisilda tohib seaduse j\u00e4rgi rannale v\u00f5i kaldale rajada, kui see ei ole vastuolus ranna ja kalda kaitse eesm\u00e4rkidega. Maakohus leidis siin, et kivisillutis ei saa \u00fcksi ega koos puidust sillaosaga t\u00e4ita paadisilla \u00fclesandeid, kuna pole vees\u00f5idukite teenindamiseks, vaid muuks rekreatiivseks tegevuseks rajatud ala.\n\nKolmandaks oli vaidlus selles, kas k\u00f5nealused ehitised ei asu ehk hoopis \u00f5uemaal. Nimelt, looduskaitseseaduse kohaselt ei laiene ehituskeeld hajaasustuses olemasoleva elamu \u00f5uemaale. Maakohus leidis siin, et \u00f5uemaa m\u00e4\u00e4ratlemisel tuleb aluseks v\u00f5tta keskmise m\u00f5istliku k\u00f5rvalseisja arusaam ning \u00f5uemaaks saab pidada maa-ala, mis on omaniku aktiivses kasutuses ja elamuga vahetus seoses. Oluline on just, et selleks, et pidada ehitist \u00f5uemaal oleks, peab ehitis teenindama kinnistul asuvat elamut ja moodustama \u00fchtse majapidamise. Kohus leidis, et kivisillutisel, t\u00fcnnisaunal ja k\u00fcmblust\u00fcnnil selline vahetu seos elamuga puudub.\n\nKokkuv\u00f5ttes, mida \u00f5ppida? Looduskaitseline ranna v\u00f5i kalda ehituskeeluv\u00f6\u00f6nd keelab reeglina igasuguste uute ehitiste, sh rajatiste paigutamise ehituskeeluv\u00f6\u00f6ndisse. Ehitisteks v\u00f5ib Keskkonnainspektsioon v\u00f5i kohus pidada aga ka selliseid asju, mida tavakeeleliselt ehitiseks pidada ei oskagi. Teine \u00f5ppetund on ehk see, et ehkki ehituskeeluv\u00f6\u00f6ndisse ehitamist lubavad mitmed looduskaitseseaduse erandid, ei tasu arvata, et kogu tegevust nende erandite alla mahutada \u00f5nnestub.
