Detailplaneering on aluseks hiljem ehitusprojekti koostamiseks ja \u2013loa taotlemiseks.\u00a0<!--more-->\n<h5><strong>\u00dcmbruskonda sobituv hoone planeerimismenetluseta\u00a0<\/strong><\/h5>\nAlates 1. juulist 2015 kehtiv planeerimisseadus v\u00f5imaldab teha \u00fcldreeglist erandi. Ehk, ilma planeerimismenetluseta saab olemasoleva hoonestuse vahele j\u00e4\u00e4vale kinnisasjale rajada \u00fche hoone koos teenindavate rajatistega. Ehitis peaks eeltingimusena sobituma juba v\u00e4ljakujunenud keskkonda ja hoonestuslaadi nii oma mahtude kui otstarbe poolest. \u00dchtlasi\u00a0peab ehitis\u00a0olema koosk\u00f5las omavalitsuse k\u00f5rgeima astme ehk \u00fcldplaneeringus m\u00e4\u00e4ratud kasutus- ja ehitustingimustega. Nende tingimuste t\u00e4idetusel v\u00f5ib omavalitsus v\u00e4ljastada planeeringu koostamiseta projekteerimistingimused, mille alusel ehitusprojekti koostama hakata. Projekteerimistingimused ongi tegelikult justkui planeering lihtsustatud kujul. Kalambuurina on paraku saatan siin mitte sugugi detailides.\n<h5><strong>Naabrid v\u00f5ivad oma \u00f5igused minetada<\/strong><\/h5>\nNimelt detailplaneeringuprotsessis saab ja tulebki avalikkus kaasata juba planeeringu koostamise faasis, enne kehtestamise otsustamist. Huvitatud isikud, n\u00e4iteks naabrid, saavad selleks enne oma arvamuse avaldamist tutvuda nii planeeritava hoonestuse ruumilise paiknemise kui koostatud m\u00f5juhinnangutega. Omavalitsus peab k\u00f5iki \u00e4ra kuulates ja erinevatest huvidest l\u00e4htudes tegema kaalutletud otsuse. L\u00f5puks on oluline seegi, et kui kellelegi kehtestatud detailplaneering kaalutlusvigade t\u00f5ttu v\u00f5i muudel p\u00f5hjustel \u00f5igusvastane tundub, saab ta kohtul paluda otsuse seaduslikkust kontrollida ilma, et peab tingimata p\u00f5hjendama, kuidas planeering tema \u00f5igusi konkreetselt kahjustab.\n\nProjekteerimistingimuste menetluses on protsess aga olulises nihkes. T\u00f5si, naabrid saab\u00a0siingi juba enne tingimuste ehk \u201elihtsustatud planeeringu\u201c v\u00e4ljastamist kaasata, ent projekteerimistingimuste andmise eel puudub nii neil kui omavalitsusel enamasti selge ruumiline ja\u00a0m\u00f5juline\u00a0ettekujutus kavandatust. Seega v\u00f5ib kaasamine osutuda silmapetteks, kui\u00a0on raske m\u00f5ista, mille kohta t\u00e4pselt arvamust avaldad. Projekteerimistingimuste v\u00e4ljastamise j\u00e4rel n\u00f5uavad osad omavalitsused\u00a0praktikas ehitusprojekti koostamisel uuesti naabrite kaasamist. See on muidugi tervitatav. Samas planeerimismenetluses on huvitatud isikute arvamust v\u00f5imalik igak\u00fclgselt kaaluda ja otsustada, kas sellist ehitist lubada. Projekteerimistingimuste v\u00e4ljastamise j\u00e4rel, v\u00e4idan, on ehitusloa andmisest keeldumine juba m\u00e4rksa\u00a0keerulisem.\n<h5><strong>Koost\u00f6\u00f6 ja kaasamine peab olema sisukas\u00a0<\/strong><\/h5>\nSeega\u00a0retooriline k\u00fcsimus \u2013\u00a0mis\u00a0tegelik t\u00e4hendus on sellises olukorras koost\u00f6\u00f6l v\u00f5i kaasamisel? Veelgi enam \u2013 siiani on kohtud asunud seisukohale, et mul kui naabril ei pruugi olla v\u00f5imalik vaidlustada ka fakti, et mind on j\u00e4etud ilma \u00f5igusest osaleda planeerimismenetluses ja asendatud see oluliselt\u00a0\u201elahjema\u00a0supiga\u201c. J\u00e4relikult seda, kas projekteerimistingimuste erandi eeldused on t\u00e4idetud, ei pruugi kohus\u00a0ka\u00a0saada \u00fcldse kontrollidagi.\n\nN\u00f5ustuda tuleb, et \u00fchelgi naabril ei saa olla veto\u00f5igust \u00fcmbritsevasse kavandatu osas ja kui k\u00f5ik on niigi selge, pole alati tarvis ka planeerimismenetlust. Arendajad ju samuti enamjaolt ei soovi naabritega t\u00fclli minna ja neid\u00a0ega omavalitsust\u00a0pole vaja\u00a0ehitustegevuse soosimise eest\u00a0demoniseerida. Teisalt tahaks loota, et kirjeldatud v\u00f5imalusest ei kujune uus praktika, kuidas naabrid oma \u00fcmbruskonna kujunemises kaasar\u00e4\u00e4kimise v\u00f5imalusest osavalt ilma j\u00e4etakse.
