Selle seaduse kohaselt saavad korteri\u00fchistute liikmeteks k\u00f5ik, kellele seaduse kehtima hakkamise hetkel kuulub korteriomand. Sealhulgas need, kes omavad nn paarismajaboksi. Eestis nimelt on suurel hulgal selliseid paarismaju, mis on jagatud korteriomanditeks.\u00a0<!--more-->\r\n<h5><strong>Praegu kehtiv seadus\u00a0<\/strong><\/h5>\r\nPraegu kehtiva korteri\u00fchistuseaduse kohaselt on korteriomanditeks jagatud hoone omanikud vabad otsustama, kas moodustada korteri\u00fchistu v\u00f5i piirduda korteriomanike \u00fchisusena tegutsemisega. Praegu ei ole kohustust luua hoone \u00fchiseks majandamiseks korteri\u00fchistut, vaid see on omanike v\u00f5imalus.\r\n\r\nKui korteriomanike enamus otsustab luua korteri\u00fchistu, siis nii saabki olema. Korteri\u00fchistu liikmeks saab aga iga korteriomanik s\u00f5ltumata tema tahtest v\u00f5i sellest, kas ta h\u00e4\u00e4letab \u00fchistu moodustamise poolt v\u00f5i vastu. See t\u00e4hendab, et k\u00f5ik korteriomanikud saavad n\u00f6 kohustuslikus korras korteri\u00fchistu liikmeteks \u00fcksnes juhul, kui enamus otsustab \u00fchistu moodustada.\r\n\r\n<a href=\"http:\/\/triniti.ee\/wp-content\/uploads\/sites\/2\/2017\/05\/Korteri\u00fchistu.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-8467\" src=\"http:\/\/triniti.ee\/wp-content\/uploads\/sites\/2\/2017\/05\/Korteri\u00fchistu-1024x576.jpg\" alt=\"\" width=\"1024\" height=\"576\" \/><\/a>\r\n<h5><strong>Uus seadus\r\n<\/strong><\/h5>\r\nUue, 2018 jaanuaris kehtima hakkava KrtS kohaselt tekivad korteriomanditeks jagatud majades korteri\u00fchistud igal juhul. Seejuures s\u00f5ltumata korteriomanike soovist ja tahtest ning sellest, kas majas on 2 v\u00f5i 200 korterit. \u00dchistu tekib igasse majasse. Kui senise seaduse kohaselt oli v\u00f5imalik moodustada \u00fcks korteri\u00fchistu ka mitmel erineval kinnisasjal asuvate hoonete \u00fchiseks majandamiseks, siis uue seadusega on see v\u00f5imalus v\u00e4listatud. Selle tagaj\u00e4rjel tekib suurel hulgal nn pisi\u00fchistuid sellistes hoonetes, milledes asuvate korterite arv j\u00e4\u00e4b alla 10.\r\n\r\nSeega tekivad Eestis alates 2018 aasta jaanuarist korteri\u00fchistud k\u00f5igisse hoonetesse, kus on v\u00e4hemalt 2 korteriomandit. Selliseid n\u00e4iteid, kus hoones on k\u00f5igest kaks korteriomandit, on \u00fcle Eesti piisavalt. Nendeks on n\u00e4iteks k\u00f5ik paarismajad, mis asuvad \u00fchel kinnisasjal ning mis on jagatud korteriomanditeks. K\u00f5igis neis moodustuvad seaduse alusel korteri\u00fchistud. Ning k\u00f5ik korteriomanikud muutuvad liikmeteks mittetulundus\u00fchingutena tegutsevates korteri\u00fchistutes.\r\n<h5><strong>Milliseid kohustusi uus seadus kaasa toob?\u00a0<\/strong><\/h5>\r\nUue seaduse kehtima hakkamine toob korteriomanikele kaasa hulga erinevaid kohustusi, mis kaasnevad korteri\u00fchistu tekke ja edaspidise olemasoluga. Muuhulgas tuleb ka nn pisi\u00fchistu raamatupidamist hakata korraldama ja pidama kehtiva seaduse kohaselt, sh tuleb esitada majandusaasta aruanne. T\u00f5si, igal juhul ei ole majandusaasta aruande koostamine ja esitamine vajalik.\r\n\r\n\u00dche v\u00f5imaliku ohuna, mille uus seadus v\u00f5ib kaasa tuua, v\u00f5ib v\u00e4lja tuua selle, et kui pisi\u00fchistu otsustab juhatust mitte valida (selline v\u00f5imalus on pisi\u00fchistule j\u00e4etud), juhivad ja esindavad k\u00f5ik korteriomanikud \u00fchistut \u00fchiselt. See t\u00e4hendab, et iga tehingut ja toimingut saab teha \u00fcksnes koos ja \u00fchiselt. T\u00f5si, ka see olukord on v\u00f5imalik lahendada, kuid seaduse m\u00f5tte kohaselt on k\u00f5igil sel juhul \u00fchine esindamise \u00f5igus.\r\n\r\nLisaks eeltoodule on siinkirjutaja hinnangul veel mitmeid probleemseid detaile ning s\u00e4tteid, mille tegelikku ellu rakendumine on k\u00fcsitav.\r\n<h5><strong>Kokkuv\u00f5tteks\u00a0<\/strong><\/h5>\r\nEt teada oma \u00f5iguseid ja v\u00f5imalikke kohustusi seoses korteri\u00fchistu tekkega, vaata endale kuuluva kinnisvara kohta kinnistusraamatust j\u00e4rgi, milline on sinu vara \u00f5iguslik staatus. Kui kinnistusraamatust n\u00e4htub, et tegemist on korteriomandiga ning Sa teadaolevalt ei ole mitte \u00fchegi korteri\u00fchistu liige, siis tea, et alates 2018 jaanuarist tekib Sulle seaduse j\u00f5uga korteri\u00fchistu liikmelisus \u00fches sellega seotud \u00f5iguste ja kohustustega.\r\n\r\nEt olla t\u00e4psemalt kursis, mida see k\u00f5ik Sulle kaasa toob, v\u00f5ta meiega \u00fchendust.
