Elanikelt v\u00e4iksemad omavalitsused, mis 1. jaanuariks 2017 ei olnud vabatahtliku \u00fchinemise teed l\u00e4inud ja millele ei kohaldata ka seaduses ette n\u00e4htud erandeid, tuleb n\u00fc\u00fcd aga kellegagi Vabariigi Valitsuse algatusel \u00fchendada. <!--more-->Nii m\u00f5nelgi juhul tekib \u201epaar\u201c KOV-iga, mis miinimumkriteeriumi kenasti t\u00e4idab ega pruugi seega sundkooselust huvitatud olla. Kas tal tuleb leppida v\u00f5i on eeskujulikul KOV-il oma \u00f5iguste kaitseks v\u00f5imalusi?\r\n\r\nHaldusreformi seadus s\u00e4testab kriteeriumile vastava omavalitsuse sundliitmiseks keeruka s\u00f5nastusega tingimused. Lihtsamalt v\u00e4ljendudes peaks liitmine olema vajalik ja otstarbekas kriteeriumile mittevastava KOV-i v\u00f5imekuse tagamiseks. Mida see aga praktikas t\u00e4hendab ja kui laialt seda v\u00f5imalust t\u00f5lgendada?\r\n\r\n<a href=\"https:\/\/triniti.ee\/wp-content\/uploads\/sites\/2\/2017\/03\/Haldusreform.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-large wp-image-8394\" src=\"https:\/\/triniti.ee\/wp-content\/uploads\/sites\/2\/2017\/03\/Haldusreform-1024x683.jpg\" alt=\"\" width=\"1024\" height=\"683\" \/><\/a>\r\n<h5><strong>Eesm\u00e4rgiks avalike teenuste parendamine<\/strong><\/h5>\r\nRiigikohus leidis, et seadusandja p\u00fcstitatud eesm\u00e4rk parandada omavalitsus\u00fcksuste v\u00f5imekust osutada avalikke teenuseid on p\u00f5hiseadusp\u00e4rane ning 5000 elaniku kriteerium ei ole selleks v\u00e4hemalt ilmselgelt asjakohatu \u2013 suuremate omavalitsus\u00fcksuste moodustamine v\u00f5ib parandada omavalitsus\u00fcksuste avalike teenuste osutamise v\u00f5imekust.\r\n\r\nRiigikohtu otsusest ja seaduse seletuskirjast v\u00f5ib j\u00e4reldada, et KOV-ide enesekorraldus\u00f5igust ehk \u201e\u00f5igust iseolemisele\u201c ei tohi riivata rohkem, kui on vajalik avalike teenuste osutamise miinimumkvaliteedi tagamiseks. Miinimumkvaliteediks ongi seadusandja s\u00e4testanud 5000 elaniku piiri. Eelistada tuleks seega, et 5000 elaniku piiri ei \u00fcletata ka sundliitmise korral rohkem kui h\u00e4dap\u00e4raselt vajalik.\r\n\r\nT\u00f5si, haldusreformi soovituslik ja kaugem eesm\u00e4rk on seaduse j\u00e4rgi v\u00e4hemalt 11\u00a0000 elanikuga omavalitsuste moodustamine. Samas ongi see r\u00f5hutatult soovituslik ja riik ei tohi sundliitmist kasutada ettek\u00e4\u00e4ndena 5000 elaniku kriteeriumist suuremate KOV-ide tekitamiseks. Ehk \u2013 kui v\u00e4iksem omavalitsus liidetakse \u00fcle 5000 elanikuga KOV-iga, ei tohi v\u00f5im minu hinnangul hoogu minna ega hakata k\u00f5iki piirkonna v\u00e4iksemaid ja suuremaid omavalitsusi omavahel \u00fchendama. \u00d5igusp\u00e4rane poleks p\u00f5hjendus, et nii on otstarbekas ja parem.\r\n<h5><strong>Meelevaldsus on vaidlustatav<\/strong><\/h5>\r\nIsegi, kui haldusreformi seadus on ses osas mitmeti m\u00f5istetav, keelab nii p\u00f5hiseadus kui kohtupraktika liitmiste meelevaldsuse ja liigse KOV-i enesekorraldus\u00f5iguse riive. V\u00e4ljumine haldusreformi eesm\u00e4rgist ja asumine KOV-ide korraldust hoogsamalt muutma oleks minu arvates ilmselgelt meelevaldne.\r\n\r\nSeega hoolimata sundliitmise kohatisest paratamatusest, ei pea KOV-id igasuguste koosluste moodustamisega leppima ning kohase arvamuse edastamine Valitsusele on enam kui vajalik.
