Ometi on tegemist lihtsa ja kiire v\u00f5imalusega oma \u00f5iguste kaitseks, kuna t\u00f6\u00f6v\u00f5tja pandi\u00f5iguse teostamine ei eelda pika ja kuluka kohtumenetluse l\u00e4bimist, samuti pole t\u00f6\u00f6v\u00f5tja pandi\u00f5iguse tekkimiseks tarvis t\u00f6\u00f6v\u00f5tulepingu poolte kokkulepet.\r\n\r\n<strong>T\u00f6\u00f6v\u00f5tja pandi\u00f5iguse tekkimisest<\/strong>\r\n\r\nKui \u00fc\u00fcrileandja pandi\u00f5igusega on kursis pea iga kinnisvara valdkonnas tegutsev v\u00f5i oma korterit \u00fc\u00fcrile andev isik, siis t\u00f6\u00f6v\u00f5tja pandi\u00f5igus on midagi sellist, millest enamik kuulnud ei ole. Nagu <strong>\u00fc\u00fcrileandja pandi\u00f5igus<\/strong>, tuleneb ka t\u00f6\u00f6v\u00f5tja pandi\u00f5igus seadusest. See t\u00e4hendab, et pandi\u00f5iguse tekkeks ei ole vaja eraldi kokkulepet t\u00f6\u00f6v\u00f5tulepingus, kuna seaduses on \u00f6eldud, et pandi\u00f5igus tekib, kui t\u00f6\u00f6v\u00f5tjal on t\u00f6\u00f6v\u00f5tulepingu alusel tellija vastu rahalised n\u00f5uded, mida tellija vabatahtlikult ei t\u00e4ida. T\u00e4hele tuleb panna, et vastava pandi\u00f5iguse eesm\u00e4rgiks on just nimetatud n\u00f5uete tagamine ning pandi\u00f5igus tekib \u00fcksnes sellistele tellija vallasasjadele, mille t\u00f6\u00f6v\u00f5tja (ehk pandipidaja) ise on valmistanud, parandanud v\u00f5i muutnud, kui need on t\u00f6\u00f6v\u00f5tu eesm\u00e4rgil tema valduses.\r\n\r\nMinu t\u00f6\u00f6lauale hiljuti sattunud kaasuses olid t\u00f6\u00f6v\u00f5tja ja tellija s\u00f5lminud teenuste osutamise lepingu, mille sisuks oli t\u00f6\u00f6v\u00f5tja poolt kaatri ehitamine, tellija poolt aga nimetatud teenuste eest tasumine ning kaasnevate kulude h\u00fcvitamine. Valmistatud kaatri n\u00e4ol oli tegemist tellija vallasasjaga, mille osas teostas t\u00f6\u00f6v\u00f5tja lepinguj\u00e4rgseid t\u00f6id ning soetas varuosasid. Tellija j\u00e4ttis t\u00f6\u00f6v\u00f5tjale kaatri tarbeks soetatud varuosade eest osaliselt maksmata. Kuna kaater oli t\u00f6\u00f6v\u00f5tja valduses, asusime t\u00f6\u00f6v\u00f5tja rahalise n\u00f5ude maksmapanemiseks realiseerima temal seaduse alusel tekkinud pandi\u00f5igust.\r\n\r\n<strong>T\u00f6\u00f6v\u00f5tja pandi\u00f5iguse teostamisest<\/strong>\r\n\r\nKuidas seadusest tulenevat pandi\u00f5igust teostada, on reguleeritud vaid \u00fcksikute paragrahvidega, mis j\u00e4tab t\u00f6\u00f6v\u00f5tjale pandi\u00f5iguse teostamisel suures osas vabad k\u00e4ed. Selles seisnebki pandipidaja \u00f5iguste maksmapanemise v\u00f5lu. See on eelduslikult lihtsam, kiirem ja odavam kui t\u00f6\u00f6v\u00f5tja tasun\u00f5ude sissen\u00f5udmine kohtu- ja sellele j\u00e4rgneva t\u00e4itemenetluse kaudu.\r\n\r\nSeaduses on \u00f6eldud, et pandipidaja n\u00f5ude rahuldamine toimub panditud asja m\u00fc\u00fcgiga avalikul enampakkumisel (v\u00f5lgniku ja pandipidaja kokkuleppel v\u00f5ib toimuda ka muul viisil). Samuti on seaduses kirjas, et pandipidaja on kohustatud v\u00f5lgnikule panditud asja m\u00fc\u00fcgist teatama \u00fcks kuu ette. Ette teatada v\u00f5ib p\u00e4rast m\u00fc\u00fcgi\u00f5iguse tekkimist. Etteteatamisest v\u00f5ib loobuda, kui teatada pole v\u00f5imalik. Sellisel juhul ei tohi panditud asja m\u00fc\u00fca enne \u00fche kuu m\u00f6\u00f6dumist m\u00fc\u00fcgi\u00f5iguse tekkimisest.\r\n\r\nEnampakkumisel v\u00f5ivad osaleda ka pandipidaja ja v\u00f5lgnik. Kui asi m\u00fc\u00fcakse pandipidajale endale, tasaarvestatakse tema n\u00f5ude rahaline v\u00e4\u00e4rtus m\u00fc\u00fcgihinnaga. V\u00f5lgniku kohustus loetakse t\u00e4idetuks panditud asja m\u00fc\u00fcgist saadud raha ulatuses, millest on maha arvatud vajalikud m\u00fc\u00fcgikulud. P\u00e4rast m\u00fc\u00fcgikulude tasumist ja pandipidaja n\u00f5ude rahuldamist tagastatakse \u00fclej\u00e4\u00e4nud raha v\u00f5lgnikule.\r\n\r\n\u00dclalkirjeldatud kaasuses oli t\u00f6\u00f6v\u00f5tjal kaatri m\u00fc\u00fcgi\u00f5igus tekkinud, vormistasime ja esitasime selleks vajalikud dokumendid (teated, m\u00fc\u00fcgikuulutused vastavates portaalides, enampakkumise ja m\u00fc\u00fcgi dokumentatsiooni) ning viisime l\u00e4bi enampakkumise. Varale leidus ostja ning tellija rahalised n\u00f5uded t\u00f6\u00f6v\u00f5tja vastu loeti t\u00e4idetuks kaatri m\u00fc\u00fcgist saadud raha ulatuses.
