{"id":20339,"date":"2015-09-03T07:18:56","date_gmt":"2015-09-03T07:18:56","guid":{"rendered":"https:\/\/triniti.eu\/?post_type=insights&#038;p=20339"},"modified":"2026-04-15T13:39:41","modified_gmt":"2026-04-15T13:39:41","slug":"ehitusvaidluste-lahendamise-abc","status":"publish","type":"insights","link":"https:\/\/triniti.1kdigital.com\/et\/insights\/ehitusvaidluste-lahendamise-abc\/","title":{"rendered":"Ehitusvaidluste lahendamise ABC"},"content":{"rendered":"\n<span style=\"color: #000000;\">Hiljutises Riigikohtu lahendis korrati \u00fcle m\u00f5ned varem juurdunud p\u00f5him\u00f5tted ehitusvaidluste lahendamiseks, kuid samas loodi projekteerija ja ehitaja vastutuse osas ka m\u00f5ningast uut praktikat (vt otsus nr\u00a0<a style=\"color: #000000;\" href=\"http:\/\/www.nc.ee\/?id=11&amp;tekst=RK\/3-2-1-60-15\" target=\"_blank\" rel=\"noopener\">3-2-1-60-15<\/a>).<\/span>\r\n\r\n<strong>Millise tulemuse pidi t\u00f6\u00f6v\u00f5tja saavutama?<\/strong>\r\n\r\nRiigikohtu hinnangul tuleb ehitusvaidluste lahendamisel esmalt selgeks teha, milline tulemus tuli projekteerijal\/ehitajal tellijaga s\u00f5lmitud lepingu alusel saavutada. Alles kokkulepitud tulemuse kindlaksm\u00e4\u00e4ramisel on vaidlust lahendaval kohtul v\u00f5imalik hinnata, kas \u00fcldse ja kui, siis millised puudused projekteerija ja\/v\u00f5i ehitaja t\u00f6\u00f6s esinesid. T\u00f6\u00f6de lepingutingimustele vastavuse hindamisel tuleb vajadusel anal\u00fc\u00fcsida, kas t\u00f6\u00f6 vastab ka keskmisele kvaliteedile, kui lepingus ei ole teisiti kokku lepitud.\r\n\r\n<strong>Kas tellija teavitas puudustest t\u00e4htaegselt?<\/strong>\r\n\r\nViidatud lahendis kordas Riigikohus \u00fcle ka tellija poolt puudustest \u00f5igeaegselt teavitamise p\u00f5him\u00f5tte. Kui vaidlust lahendav kohus on kindlaks teinud t\u00f6\u00f6v\u00f5tjatele etteheidetavad puudused, tuleb kohtul hinnata, kas tellija saab neile puudustele \u00fcldse tugineda. Selleks tuleb kohtul v\u00f5tta seisukoht, kas tellija on lepingule mittevastavusest t\u00f6\u00f6v\u00f5tjaid teavitanud \u00f5igel ajal, so m\u00f5istliku aja jooksul p\u00e4rast seda, kui ta t\u00f6\u00f6 lepingutingimustele mittevastavusest teada sai v\u00f5i teada saama pidi.\r\n\r\n\u00dcldreegli kohaselt hakkab t\u00f6\u00f6 puudustest teatamise m\u00f5istlik aeg kulgema alates t\u00f6\u00f6 \u00fclevaatamisest. Samas ei hakka teavitamise m\u00f5istlik t\u00e4htaeg kulgema t\u00f6\u00f6 \u00fclevaatamisest juhul, kui tegemist on varjatud puudustega. Tuleb eristada tavap\u00e4rasel \u00fclevaatamisel avastatavaid puudusi nn <em>varjatud puudustest<\/em>, s.o lepingutingimustele mittevastavusest, mida tellija ei v\u00f5inuks avastada t\u00f6id k\u00e4ibes vajaliku hoolsusega \u00fcldiselt v\u00e4liselt \u00fcle vaadates. Ka juhul, kui t\u00f6\u00f6 vaatab \u00fcle asjatundja, tuleb t\u00f6\u00f6v\u00f5tjat teavitada vaid v\u00e4lisel vaatlusel \u00e4ratuntavatest t\u00f6\u00f6l esinevatest puudustest. Riigikohus r\u00f5hutas, et \u00fckski tellija ei pea rakendama erakorralisi meetmeid t\u00f6\u00f6s esinevate puuduste tuvastamiseks, mh palkama selleks nt asjatundja.\r\n\r\n<strong>Kas tellija kirjeldas puudusi piisavalt t\u00e4pselt?<\/strong>\r\n\r\nL\u00e4htuvalt projekteerija\/ehitaja t\u00f6\u00f6s tuvastatud puudustest, tuleb vaidlust lahendaval kohtul hinnata ka seda, kas tellija kirjeldas lepingule mittevastavust piisavalt t\u00e4pselt. Riigikohus r\u00f5hutas juurdunud p\u00f5him\u00f5tet, et vajalik ei ole puuduse p\u00f5hjuse v\u00e4ljatoomine, vaid selle iseloomu kirjeldamine ulatuses, milles see on v\u00f5imalik p\u00e4rast eriteadmisi mitte eeldavat t\u00f6\u00f6 v\u00e4list \u00fclevaatust. Tellija ei pea puuduste kirjeldamiseks tegema ekspertiisi, st ka professionaalselt tellijalt saab eeldada puuduste kirjeldamist vaid \u00fcldiselt.\r\n\r\nUudse seisukohana t\u00f5i Riigikohus v\u00e4lja aga selle, et teavitamise ning puuduste kirjeldamise kohustuse t\u00e4itmiseks v\u00f5ib piisata ka ehitisega seoses toimunud avariist teavitamisest ning olukorra fikseerimisest s\u00fcndmuskohal koos t\u00f6\u00f6v\u00f5tjaga. Isegi kui tellija tegutseb majandustegevuses, on t\u00f6\u00f6v\u00f5tulepingu raames asjatundjaks eelk\u00f5ige t\u00f6\u00f6v\u00f5tja. Seet\u00f5ttu v\u00f5ib Riigikohtu hinnangul eeldada, et kui t\u00f6\u00f6v\u00f5tja tutvub asjaoludega s\u00fcndmuskohal, suudab ta ise selgeks teha t\u00f6\u00f6 puuduste iseloomu.\r\n\r\n<strong>Milline kahju tuleb tellijale h\u00fcvitada?<\/strong>\r\n\r\nTellijale h\u00fcvitamisele kuuluva kahju osas kordas Riigikohus \u00fcle p\u00f5him\u00f5tte, et lepingu rikkumise korral on kahju h\u00fcvitamise eesm\u00e4rgiks kahju kandnud isiku asetamine olukorda, milles ta oleks olnud, kui lepingut ei oleks rikutud. Sealjuures ei tohi kahju h\u00fcvitamine olla kannatanu rikastumise allikaks. Seega on kahju h\u00fcvitamisel l\u00e4htekohaks lepinguga kokkulepitud tulemus. N\u00e4iteks juhul, kui vaidlust lahendav kohus tuvastab, et pooled leppisid ehitamise kontekstis kokku <em>toimiva<\/em> tehnos\u00fcsteemi \u00fcleandmises (mitte s\u00fcsteemi <em>konkreetses<\/em> <em>tehnilises lahenduses<\/em>), siis tuleb lepingut rikkunud t\u00f6\u00f6v\u00f5tjal h\u00fcvitada kulud, mis on vajalikud toimiva tehnos\u00fcsteemi rajamiseks.\r\n\r\nH\u00fcvitis peab olema nii suur, et tellijal oleks v\u00f5imalik kahju h\u00fcvitamise hetkel soetada samav\u00e4\u00e4rne asi (nt tellida uue samav\u00e4\u00e4rse tehnos\u00fcsteemi rajamine kolmandalt isikult).
