Viidatud osa\u00fching s\u00f5lmib ehitajaga ehituslepingu ning samal ajal hakkab ehitatavatele pindadele ostjaid otsima, s\u00f5lmides ostjatega esialgu tavalised m\u00fc\u00fcgilepingud. Peale hoone valmimist ja korteriomandite l\u00f5plikku m\u00fc\u00fcki arendajaks ja m\u00fc\u00fcjaks olev osa\u00fching likvideeritakse, kuiv\u00f5rd osa\u00fching on oma eesm\u00e4rgi t\u00e4itnud. Ehitis elab aga oma elu edasi, ilmutades aja m\u00f6\u00f6dudes nii pisipuudusi kui ka halvemal juhul suuremat ehituspraaki. V\u00f5la\u00f5igusseaduse loogika n\u00e4eks ette, et puuduste k\u00f5rvaldamist tuleks n\u00f5uda asja m\u00fc\u00fcjalt ehk siis korteriomandi m\u00fc\u00fcnud osa\u00fchingult, kuid tihti on olukord praktikas see, et osa\u00fching on likvideeritud ning omanikud on oma n\u00f5uetega \u00fcksi ja ehitajalt n\u00f5uda vastutust oma tegevuse eest on enam kui keeruline.\r\n\r\nSiiski on v\u00f5la\u00f5igusseaduses \u00fcks erandlik s\u00e4te, mis v\u00f5imaldab korteriomanikel esitada n\u00f5uet ka otse ehitaja vastu ilma, et korteriomanikel oleks ehitajaga leping s\u00f5lmitud. Nimelt s\u00e4testab v\u00f5la\u00f5igusseadus, et eksisteerib kolmandat isikut kaitsev leping ehk leping, millega kaasneb kohustus arvestada kolmanda isiku huvide ja \u00f5igustega samal m\u00e4\u00e4ral, kui v\u00f5lausaldaja huvide ja \u00f5igustega. Minu hinnangul v\u00f5ib teatud tingimuste ja eelduste t\u00e4itmisel olla ka ehitusleping kolmandat isikut kaitsev leping, mille pooleks korteriomanikud isiklikult ei ole.\r\n\r\nViidatud paragrahvi eesm\u00e4rk on s\u00e4testada lepingust tulenevate kaitse- v\u00f5i hoolsuskohustuse rikkumise puhul kaitse nendele isikutele, kes ei ole lepingu osapooled ja kelle huvide kaitse ei olnud lepingu s\u00f5lmimise eesm\u00e4rk. Ehituslepingu n\u00e4ite puhul tagada kaitse korteriomandi omandajatele, kes reaalselt ka ehitist kasutama hakkavad.\r\n\r\nSelleks, et tekiks ehitaja vastutus korteriomanike ees, on vaja t\u00e4ita kolm seaduses s\u00e4testatud eeldust. Esmane eeldus on see, et kolmanda isiku ehk siis korteriomanike ja arenduse tellijaks oleva osa\u00fchingu huvid ehituslepingu t\u00e4itmise osas peavad olema sama intensiivsusega. Eeltoodu t\u00e4hendab, et nii korteriomanike kui ka ka arendaja huvi ehituslepingu t\u00e4itmise vastu peab olema p\u00f5him\u00f5tteliselt identne. Teiseks eelduseks on see, et v\u00f5lausaldajal ehk siis ehitise tellinud osa\u00fchingul peab olema tahe soodustada kolmandat isikut ehk tuleb tuvastada olukord, et arendaja on soovinud laiendada lepingulist kaitset ka kolmandatele isikutele. Lihtsustatult \u00f6eldes peaks olema selge, et arendaja soovib soodustada korteriomandite ostjate n\u00f5uete esitamist otse ehitaja vastu. Viimaseks eelduseks on asjaolu, et v\u00f5lgnikule ehk siis meie n\u00e4ite puhul ehitajale, peab olema selge v\u00f5lausaldaja tahe soodustada kolmandat isikut ning piisavalt selge peab olema ka kolmandate isikute ring. Ehitajale peab olema selge, et juhul kui tema t\u00f6\u00f6 ei vasta n\u00f5uetele on v\u00f5imalik, et ka korteriomandite omanikud esitavad otse ehitaja vastu n\u00f5udeid. Viidatud eelduste \u00fcheaegsel t\u00e4itumisel on ehitaja vastutus korteriomanike ees tuvastatud ning ehitaja on kohustatud h\u00fcvitama kahju, mis on seotud ehitaja tekitatud kahjuga.\r\n\r\nTegemist on \u00e4\u00e4rmiselt erandliku s\u00e4ttega ning vastavat kohtupraktikat Eestis ehituslepingute osas veel tekkinud ei ole, kuid minu hinnangul on ehitaja vastutus kolmandat isikut kaitsva lepingu alusel t\u00f5en\u00e4oline.
