Seadusandja p\u00fc\u00fcdis parimal viisil kokku liita seni kehtinud korteriomandiseaduse ja korteri\u00fchistuseaduse, kuid v\u00e4hemalt \u00fches aspektis saab t\u00f5deda, et v\u00e4lja kukkus nii nagu tavaliselt ehk et selguse asemel tekkis \u00fcks suur ja segane \u00f5iguslik probleem.\r\n\r\nNimelt on seadusandja ette n\u00e4inud, et k\u00f5ikide korteriomandite osas, mis eksisteerivad kinnistusraamatus ja mille valitsemiseks ei ole korteri\u00fchistut loodud (edaspidi K\u00dc), tekib KrtS-i j\u00f5ustumisel automaatselt K\u00dc. Idee poolest v\u00e4ga tore lahendus, korteriomanikele tekib v\u00e4ga mugavalt juriidiline keha, mille alt korraldada hoone majandamist. Kuid eeltoodu kehtib vaid olukorras, kus reaalselt on ka olemas korteriomandid, mida majandada.\r\n\r\nT\u00e4helepanuta on aga j\u00e4\u00e4nud olukord, kus tegemist on vanade, lagunenud ja t\u00fchjaks j\u00e4\u00e4nud hoonetega, kus puuduvad elanikud ja kuhu elanikke ka ei teki, kuid K\u00dc on loodud.
