Defended the rights of the creator of Lithuanian children’s characters Kakė Makė to the trademark NANAISA

In a recent trademark dispute, we represented our client “Kakė Makė” in an opposition against the registration of the trademark “NANAISA”. The opposition was rejected, confirming the registration of the trademark “NANAISA” and the lack of similarity to the trademark “NANA”.

This decision emphasises the importance of a comprehensive assessment of the similarity of the marks, taking into account visual, aural and semantic aspects, in order to identify possible consumer confusion, the overall impression that the average consumer has of the mark being more important than a comparison of the individual components.

As a reminder, companies should note that when applying for trade marks, it is necessary to ensure that the marks are not similar to previously registered trade marks.
