Tai yra savaranki\u0161kas darbo sutarties pasibaigimo pagrindas ir jokio papildomo pagrindo ie\u0161koti nereikia. Darbo kodekso 104 straipsnio 2 dalyje numatyta, jog ji turi b\u016bti i\u0161mokama esant trims s\u0105lygoms:\r\n1) darbo santykiai truko ilgiau kaip dvejus metus;\r\n2) vadovas at\u0161aukiamas prie\u0161 darbo sutarties termino pabaig\u0105;\r\n3) at\u0161aukim\u0105 l\u0117m\u0117 ne vadovo kalti veiksmai, o kitos prie\u017eastys.\r\n\r\nDarbo kodekso 69 straipsnio 4 dalis, kuri taip pat taikoma vadovui, numato i\u0161 esm\u0117s tas pa\u010dias s\u0105lygas i\u0161eitin\u0117s i\u0161mokos mok\u0117jimui:\r\n1) darbo santykiai truko ilgiau kaip dvejus metus;\r\n2) terminuota darbo sutartis pasibaig\u0117 su\u0117jus terminui;\r\n3) sutarties nutraukimo pagrindas yra jos termino pasibaigimas, o ne vadovo kalt\u0117 ar kitos prie\u017eastys. Pastaruoju atveju skiriasi\r\ntik nutraukimo pagrindas &#8211; vietoje vadovo at\u0161aukimo prie\u0161 termin\u0105 taikomas sutarties pasibaigimas su\u0117jus terminui.\r\n\r\n\r\n\r\n\r\n\r\n\u0160ioje vietoje esminis klausimas kyla d\u0117l darbo sutarties r\u016b\u0161ies.\r\n\r\n\r\n\r\n\r\n\r\nDarbo kodekso nuostat\u0173 analiz\u0117 leid\u017eia daryti i\u0161vad\u0105, kad vadovo vieno m\u0117nesio vidutinio darbo u\u017emokes\u010dio dyd\u017eio i\u0161eitin\u0117 i\u0161moka priklauso vadovui tik tuo atveju, kai sutartis yra terminuota, kadangi kalbama apie at\u0161aukim\u0105 prie\u0161 darbo sutarties termino pabaig\u0105. VDI teigia, jog draudimas atleisti i\u0161 darbo darbuotoj\u0105 jam suteikt\u0173 tikslini\u0173 atostog\u0173 metu savo prigimtimi yra socialin\u0117 garantija.\r\n\r\n\r\n\r\n\r\n\r\nApibendrinant, nor\u0117t\u0173si pa\u017eym\u0117ti, jog parenkant vadovo darbo sutarties r\u016b\u0161\u012f, svarbu apsvarstyti terminuotos darbo sutarties privalumus ir tr\u016bkumus.
