Remiantis Darbo kodekso 37 straipsnio 2 dalimi, atlyginamos yra tik i\u0161laidos, susijusios darbuotojo \u017eini\u0173 ar geb\u0117jim\u0173, vir\u0161ijan\u010di\u0173 darbo veiklai keliamus reikalavimus, suteikimu. Kriterij\u0173 ir pavyzd\u017ei\u0173, kokios \u017einios ir geb\u0117jimai gali b\u016bti laikomi vir\u0161ijan\u010diais darbo veiklai keliamus reikalavimus, Darbo kodeksas nepateikia, tod\u0117l juos pateikti buvo pra\u0161oma kasacinio teismo.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Nutartimi Lietuvos Auk\u0161\u010diausiasis Teismas pasisak\u0117, kad Darbo kodekso 37 straipsnio 2 dalyje \u012ftvirtinta taisykl\u0117 turi b\u016bti ai\u0161kinama kartu su Darbo kodekso 29 straipsniu, \u012ftvirtinan\u010diu darbdavio pareig\u0105 apmokyti darbuotoj\u0105 dirbti tiek, kiek b\u016btina jo darbo funkcijai atlikti, ir imtis priemoni\u0173 darbuotojo kvalifikacijai ir j\u0173 profesionalumui, geb\u0117jimui prisitaikyti prie besikei\u010dian\u010di\u0173 verslo, profesini\u0173 ar darbo s\u0105lyg\u0173 didinti. Darbuotojo pareiga atlyginti darbdavio patirtas mokymo i\u0161laidas tur\u0117t\u0173 atsirasti tuomet, jei darbuotojas, kuris ir be apmokym\u0173 ar kvalifikacijos k\u0117limo yra tinkamas eiti pavestas funkcijas, \u012fgyja papildom\u0173 \u017eini\u0173 ar geb\u0117jim\u0173, vir\u0161ijan\u010di\u0173 jo atliekamam darbui (funkcijoms) keliamus reikalavimus (kompetencij\u0105), kurie suteikia papildomos vert\u0117s darbuotojui darbo rinkoje, padidina darbuotojo vert\u0119.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Reikalavim\u0105 priteisti darbuotojo mokymui patirtas i\u0161laidas ie\u0161kovas grind\u0117 darbo sutartyje \u012ftvirtintu susitarimu ir dalyvavim\u0105 renginiuose, j\u0173 apmok\u0117jim\u0105 patvirtinan\u010diais \u012frodymais. Kad darbo sutarties nutraukimo atveju gal\u0117t\u0173 susigr\u0105\u017einti \u012f darbuotoj\u0105 padarytas investicijas, darbdavys dar prie\u0161 darydamas \u0161ias investicijas tur\u0117t\u0173 imtis papildom\u0173 apsaugos priemoni\u0173.
